TrackVIN provides comprehensive vehicle history reports based on Vehicle Identification Numbers (VINs). Our services include:

• Vehicle history reports containing title information, accident records, and ownership history
• Service and maintenance records when available
• Recall information and safety notices
• Market value estimations
• Theft and recovery records
• Lien and loan information
• Previous use history (rental, taxi, fleet, etc.)

3. User Accounts and Registration

Account Creation

To access certain features of our service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

Account Termination

We reserve the right to terminate or suspend your account at any time for violations of these Terms, fraudulent activity, or any other reason we deem necessary to protect our service and other users.

Our current pricing is clearly displayed on our website. All prices are in USD unless otherwise stated. We reserve the right to change our pricing at any time, but price changes will not affect orders already placed.

Payment Processing

You acknowledge that our reports are tools to assist in your decision-making process and should not be the sole basis for any purchase decision. We recommend having any vehicle inspected by a qualified mechanic before purchase.

7. Intellectual Property Rights

Our Content

The service and its original content, features, and functionality are and will remain the exclusive property of TrackVIN and its licensors. The service is protected by copyright, trademark, and other laws.

Your Use Rights

We grant you a limited, non-exclusive, non-transferable license to:

• Access and use the service for your personal or business purposes
• Download and print reports you have purchased for your own use
• Share reports with parties directly involved in a vehicle transaction

Restrictions

You may not:

• Reproduce, distribute, or create derivative works from our content
• Use our trademarks without written permission
• Reverse engineer or attempt to extract source code
• Remove or alter any proprietary notices

8. Privacy and Data Protection

9. Limitation of Liability

Our total liability to you for any damages arising from or related to these Terms or your use of the service shall not exceed the amount you paid us for the specific service that gave rise to the claim during the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless TrackVIN and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

This indemnification applies to claims arising from:

• Your use of and access to the service
• Your violation of any term of these Terms
• Your violation of any third party right, including intellectual property rights
• Any claim that your use caused damage to a third party

11. Termination

Termination by You

You may terminate your account at any time by contacting us. Upon termination, your right to use the service will cease immediately.

Termination by Us

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever including but not limited to a breach of the Terms.

Effect of Termination

Upon termination, your right to use the service will cease immediately. If you wish to terminate your account, you may simply discontinue using the service. All provisions of the Terms which by their nature should survive termination shall survive termination.

12. Governing Law and Jurisdiction

These Terms shall be interpreted and governed by the laws of the State of Virginia, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Virginia.

You hereby consent to the personal jurisdiction of such courts and waive any objection to the laying of venue of any such proceeding in such courts.

13. Dispute Resolution

Informal Resolution

Before filing a claim against TrackVIN, you agree to try to resolve the dispute informally by contacting us at legal@trackvin.info. We'll try to resolve the dispute informally by contacting you via email.

Arbitration

If we can't resolve the dispute informally, any dispute arising out of or relating to these Terms or the service will be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.

Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.

15. Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

No waiver by TrackVIN of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

16. Entire Agreement

These Terms constitute the sole and entire agreement between you and TrackVIN regarding the service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the service.
